Parcel Terms & Conditions 1. Area of application Our quotation and DSV’s Services are subject to these DSV Parcel Terms & Conditions, the DSV Standard Terms & Conditions, the latest Edition of the British International Freight Association (BIFA) Standard Trading Conditions and any other terms mentioned in our quotation, including but not limited to weight and dimension requirements, general requirements and additional service requirements. In case of any discrepancies, they will prevail in the following order: (1) (BIFA) Standard Trading Conditions, (2) DSV Parcel Terms & Conditions, (3) DSV Standard Terms & Conditions and (4) any other terms mentioned in our quotation. Capitalised terms used in these DSV Parcel Terms & Conditions have the same meaning as defined in the DSV Standard Terms & Conditions unless defined differently herein. For the avoidance of doubt any reference in these DSV Parcel Terms and Conditions to: “Consignee” shall refer to the party named “Consignee” in the consignment note. "DSV Parcel" shall mean "DSV" as defined in the DSV Standard Terms & Conditions and the carrier field in the consignment note or the contracting DSV entity in any given quotation. In the event of conflict, the contracting DSV entity in any given quotation shall prevail. “Shipper” shall refer to the party named “Shipper” in the consignment. These DSV Parcel Terms & Conditions apply to the transportation of consignments which are surrendered to us using the “DSV Parcel” dispatch order made available by DSV Parcel for this purpose or with a consignment note issued via our DSV Parcel online booking portal and accepted by DSV Parcel for transportation. The DSV Standard Terms & Conditions are available on www.dsv.com, or sent directly to you upon request. The Shipper is requested to familiarise itself with the DSV Parcel Terms & Conditions prior to shipment. DSV Parcel reserves the right to amend and supplement the DSV Parcel Terms & Conditions unilaterally without informing our contractual partners separately. The current version published on the website www.dsv.com applies in each case. The application of any general terms and conditions of the Shipper or other third parties, other than as expressly provided in these DSV Parcel Terms and Conditions, is expressly excluded. Any agreements differing from these DSV Parcel Terms & Conditions are subject to an express written agreement between the Shipper and DSV Parcel. Unless otherwise stipulated in mandatorily applicable statutory legislation or international conventions, these DSV Parcel Terms & Conditions shall apply. Third party rights: Other than expressly provided in this Agreement this Agreement does not give rise to any rights under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement. The rights of the parties to rescind or vary this agreement are not subject to the consent of any other person. 2. Services I. DSV Parcel service portfolio includes: - DSV XPress : Delivery of documents and consignments worldwide in the shortest time possible. - DSV XPress Economy : National and international forwarding for non-urgent consignments. - DSV Parcel / Parcel E-Commerce : National and international parcel forwarding for non-urgent consignments. - DSV XPress Special Services : National and international forwarding for top-urgent consignments. II. DSV Parcel selects the mode of transport with the diligence of a prudent businessman. 3. Fee Prices mentioned are excluding VAT and surcharges of any kind. The prices are subject to change and based on the chargeable weight/volume factor. The chargeable weight will be rounded up. DSV Parcel is entitled to change the prices with 30 days written notice. Surcharges will be charged in addition to the prices at the applicable rate of the day of shipment. Applicable surcharge rates are found at: Service and Surcharges (UK) Services and Surcharges (NI) Services and Surcharges (IE) DSV Parcel reserves the right to change and introduce new surcharges without notice. Please also note the payment and payment terms section of the DSV Standard Terms & Conditions. 4. Excluded goods Unless otherwise expressly agreed, the following Goods or shipments are excluded from Services: 1. Goods with insufficient packaging. 2. Dangerous goods which require special handling (e.g. those for which a DGR statement is required). 3. Valuable consignments (e.g. precious metals, gemstones, etc.) and works of art; jewelry and watch consignments with a value exceeding €500. 4. Perishable goods (e.g. foodstuffs). 5. All types of weapons as well as self-igniting and explosive goods. 6. All types of removal goods. 7. All types of pharmaceuticals. 8. Plants and animals. 9. Currency and securities including stamps. 10. Alcohol, tobacco and pornographic publications and articles. 11. All goods whose import and export are prohibited according to the applicable national regulations in each case. 12. Letter of credit consignments. 13. Cash on delivery consignments. 14. Furs. 15. Computers, laptops, tablets, mobile phones with a total value above €50,000. 5. Inspection DSV Parcel is entitled, but not obligated at DSV Parcel own request or by official directive, to open consignments surrendered for transportation without incurring any liability in this respect. 6. Liability DSV Parcel's liability is subject to and limited in accordance with the limits of liability of the 'Company' contained in the BIFA Standard Trading Conditions and otherwise the DSV Standard Terms & Conditions. 7. Insurance DSV Parcel may, by special written request, take out a Cargo Insurance for the transport of Goods in favor of the Shipper and for the Shipper's cost with an insured sum of maximum of €100.000. It is the obligation of the Shipper to state the value of the consignment and the nature of the consignment correctly in order to ensure the insurance cover. Notwithstanding the above, in no case shall the Cargo Insurance cover: Shipments of deeds and securities and treasury notes and the like, designs, patterns, plans and manuscripts, helicopters, livestock, bloodstock, living creatures, and money (including bank notes and coins), stamps, duty stamps and the like. 8. Partial invalidity Should one of the provisions of these DSV Parcel Terms & Conditions be or become invalid, the validity of the remaining provisions shall not be affected thereby. The invalid provision shall be replaced by a valid provision that comes closest to the economic content of the invalid provision. The same shall apply in case of unintentional gaps. 9. Choice of law / Place of jurisdiction English law shall apply to these DSV Parcel Terms & Conditions and the Agreement between DSV Parcel and the Shipper and to any disputes arising out of or in connection therewith. Any dispute or claims arising out of or relating to or in connection with these DSV Parcel Terms & Conditions or the Agreement between DSV Parcel and the Shipper shall be subject to the exclusive jurisdiction of the courts in England and Wales to which the Parties irrevocably submit. 10. No commitment and time guarantee DSV Parcel is not obliged to accept any orders for Services. DSV Parcel will make reasonable endeavours to accept transport orders as and when requested by the Shipper from time-to-time. Unless agreed expressly in writing that the Goods shall depart/be collected by or arrive/be delivered by a particular date or time, DSV Parcel accepts no responsibility for departure/collection or arrival/delivery dates or times of Goods. ETA (Estimated Time or Arrival), ETD (Estimate Time of Departure) or any other similar estimated or indicative times/dates shall not be construed as a time guarantee on the part of DSV Parcel. # DSV internal
